1.Definitions

The following terms have these meanings throughout these Terms of Service:

2.Acceptance of Terms

By accessing or using EncounterCaster (available at our websites and related domains), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

These Terms apply to all visitors, registered users, and paying subscribers. By creating an account, purchasing a subscription or one-time plan, or generating content through our platform, you confirm that you have read, understood, and agreed to these Terms.

By purchasing, you agree to these Terms of Service. This agreement is presented and must be acknowledged at checkout.

If you are using EncounterCaster on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3.Description of Service

EncounterCaster is an AI-powered campaign management platform for tabletop role-playing game (TTRPG) Game Masters. The Service includes:

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice. We will not be liable to you for any modification, suspension, or discontinuation of the Service.

4.Accounts & Registration

You must create an account to access most features of EncounterCaster. You agree to:

You must be at least 13 years of age to create an account. Accounts for users under 18 should be created and supervised by a parent or legal guardian.

COPPA — Children Under 13

We do not knowingly collect personal information from children under 13. If we learn that we have collected personal information from a child under 13, we will delete such data within 30 days of discovery, or as soon as practicable. If you believe a child under 13 has provided us with personal information, please contact us immediately at support@encountercaster.com so we can take appropriate action.

We reserve the right to refuse registration, suspend, or terminate accounts at our sole discretion, including accounts that violate these Terms.

5.Acceptable Use Policy

You agree to use EncounterCaster only for lawful purposes consistent with these Terms. You must not use the Service to:

Zero Tolerance: Content depicting, normalizing, or contextualizing the sexual abuse or exploitation of minors will result in immediate, permanent account termination and may be reported to relevant authorities.

EncounterCaster targets a PG-13 / PEGI 12 content standard. If you encounter content you believe violates our standards, please report it to support@encountercaster.com.

6.Payments & Subscriptions

EncounterCaster offers three distinct purchase options for each membership tier (Adventurer, Hero, Master, and Pro). Choose the option that works best for you. Current pricing is displayed on our Pricing page.

Purchase Options

Monthly One-Time

Purchase one month at full price.

No auto-renewal. Expires at end of purchased month.

Must manually re-purchase to continue access.

Monthly Subscription

Auto-renews every month.

15% discount (same rate as 6-month bulk pricing).

Cancel anytime. Access continues through end of current billing period.

Bulk Purchase

Pay 6 or 12 months upfront. One-time payment, no auto-renewal.

6 months: 15% off. 12 months: 20% off.

No refunds on bulk purchases.

Auto-Renewal — Subscriptions Only

Only the Monthly Subscription option auto-renews. Your payment method will be charged automatically each month until you cancel. Monthly one-time purchases and all bulk purchases do not auto-renew — you will never be charged again without initiating a new purchase.

For monthly subscriptions, we may send a reminder before renewal, but failure to receive such notice does not affect the validity of charges. You may cancel at any time through your account settings or by contacting support@encountercaster.com. Cancellation takes effect at the end of your current billing period; you retain access until then.

Tier Upgrades & Downgrades

Bonus Packs

Bonus Packs are separate, one-time purchases of additional encounter generation credits. They are not subscriptions, never expire, and are available to any account regardless of tier. Bonus Packs are non-refundable once any portion has been consumed.

Refund Policy

For billing errors (duplicate charges, system failures), contact support@encountercaster.com. We review genuine billing errors on a case-by-case basis.

Payment Processing

Payments are processed by Stripe, Inc. By making a purchase, you also agree to Stripe's Terms of Service. We do not store your full payment card information on our servers.

Summary: Monthly subscription auto-renews at 15% off — cancel anytime. Monthly one-time and all bulk purchases do NOT auto-renew. Bulk purchases are non-refundable. Upgrades are pro-rated; downgrades are not refunded.

7.User-Generated Content

Your Content

"Content" means any material you submit, upload, or create using EncounterCaster, including campaign names, custom notes, character details, and input prompts.

You retain ownership of your Content. By submitting Content, you grant us a limited, worldwide, royalty-free license to store, process, and display that content solely for the purpose of providing the Service to you.

Content Responsibility

You are solely responsible for reviewing Generated Content before sharing it, particularly with younger audiences. We reserve the right to remove any Content or Generated Content that violates these Terms without notice.

8.AI Content & Usage Rights

"Generated Content" means AI-produced text, images, stat blocks, encounter descriptions, character backstories, and other outputs produced by the Service in response to your inputs.

Content generated by EncounterCaster is produced using artificial intelligence. Generated content may not be eligible for copyright protection under current law. You are solely responsible for determining the intellectual property status of any generated content before redistribution, resale, or commercial use. EncounterCaster makes no representations regarding your ownership rights in generated content.

No Warranties on Generated Content

EncounterCaster makes no warranties about the accuracy, completeness, fitness for purpose, or originality of AI-generated content. Generated Content may contain errors, inconsistencies, or deviations from official TTRPG rules. Use your own judgment before publishing or sharing.

Open License Attribution

Generated Content is produced using mechanics from the SRD 5.2 (CC-BY-4.0) and FATE Core (CC-BY-3.0). If you publish or distribute Generated Content publicly or commercially, you must include the appropriate attribution notices for any open-licensed content incorporated. See Section 9 (Intellectual Property) for required attribution language.

AI Training

We do not use your Content prompts to train AI models without your explicit consent.

No Professional Advice

The Service and any Generated Content are provided for informational and entertainment purposes only and do not constitute legal, financial, or professional advice of any kind.

9.Intellectual Property

EncounterCaster Platform

The EncounterCaster platform — its software, design, interface, branding, and original content — is owned by Ryan Williams (EncounterCaster) and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or create derivative works of our platform without express written permission.

D&D 5th Edition SRD 5.2 (CC-BY-4.0)

EncounterCaster generates content using mechanics from the D&D 5th Edition Systems Reference Document 5.2 by Wizards of the Coast LLC, made available under the Creative Commons Attribution 4.0 International License (CC-BY-4.0).

This work includes material taken from the System Reference Document 5.2 ("SRD 5.2") by Wizards of the Coast LLC, available at dndbeyond.com/resources/1781-systems-reference-document-srd. The SRD 5.2 is licensed under the Creative Commons Attribution 4.0 International License.

If you publish or distribute Generated Content commercially or publicly, you must include the appropriate CC-BY-4.0 attribution notice for SRD 5.2 content and, where applicable, CC-BY-3.0 attribution for FATE Core content. For full attribution guidance, see our Legal & Attribution page.

10.DMCA & Copyright Takedown

Reporting Copyright Infringement

If you believe that content on the Service infringes your copyright, you may submit a written DMCA takedown notice to:

Required Elements of a DMCA Notice

Your notice must include all of the following to be valid:

  1. A physical or electronic signature of the copyright owner (or authorized agent)
  2. Identification of the copyrighted work you claim has been infringed
  3. Identification of the material you claim is infringing, with sufficient detail for us to locate it
  4. Your contact information (name, address, telephone number, and email address)
  5. A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law
  6. A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf

Our Response

Upon receiving a valid DMCA notice, we will promptly remove or disable access to the allegedly infringing content. We will notify the user who posted the content, where practicable.

Counter-Notice Procedure

If you believe your content was removed in error, you may submit a counter-notice to support@encountercaster.com (Subject: DMCA Counter-Notice) including: your contact information, identification of the removed content, a statement under penalty of perjury that you have a good-faith belief the content was removed by mistake, your consent to jurisdiction of a federal court in Oregon, and your signature. Upon receipt of a valid counter-notice, we may restore the content within 10–14 business days unless the original complainant files a court action.

Repeat Infringer Policy

In appropriate circumstances, we will terminate the accounts of users who are determined to be repeat infringers of copyright.

11.Account Termination

Termination by You

You may close your account at any time by contacting support@encountercaster.com or through account settings. No refunds are issued for unused subscription time at the point of voluntary account closure.

Termination by Us

We reserve the right to suspend or permanently terminate your account, with or without notice, if:

Termination for cause: no refund. Termination without cause: pro-rated refund for unused, pre-paid bulk subscription time.

Effect of Termination

Upon termination, your right to access the Service immediately ends. We may delete your account data per our data retention practices. Provisions that by their nature should survive termination will do so, including Sections 8, 9, 12, 13, 14, and 18.

12.Indemnification

You agree to defend, indemnify, and hold harmless Ryan Williams (sole proprietor, Oregon, USA), doing business as Encounter Caster, and his successors, assigns, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with:

We reserve the right, at our own expense, to assume exclusive defense and control of any matter subject to indemnification by you. You agree to cooperate with our defense of such claims.

13.Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Data Loss Disclaimer

We strive to maintain your data but cannot guarantee against data loss. You are responsible for maintaining your own backups of any Content or Generated Content you wish to preserve. EncounterCaster is not liable for any loss of data, including account content, saved encounters, campaigns, or generated material, whether due to technical failure, service interruption, or any other cause.

Use of the Service is entirely at your own risk. You are responsible for independently verifying the accuracy and appropriateness of any Generated Content before use.

14.Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, Ryan Williams, doing business as Encounter Caster, SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES arising out of or related to your use of the Service, including loss of data, loss of profits, or loss of goodwill — even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for all claims shall not exceed the greater of:

Some jurisdictions do not allow limitation of liability for certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

15.Force Majeure

Neither party shall be liable for any failure or delay in performance under these Terms to the extent such failure or delay is caused by circumstances beyond that party's reasonable control, including but not limited to:

The affected party will provide reasonable notice of such an event and will use commercially reasonable efforts to resume performance as soon as practicable. Force majeure events do not excuse payment obligations already incurred.

16.Privacy & Cookies

Data We Collect

How We Use Your Data

We use your data to provide and improve the Service, process payments, send transactional emails, detect and prevent abuse, and comply with legal obligations. We do not sell your personal data to third parties. We do not use your content prompts to train AI models without your explicit consent.

Cookies

We do not use advertising cookies or third-party tracking pixels. You can disable cookies in your browser, but doing so may impair Service functionality.

Data Retention & Deletion

We retain account data for as long as your account is active. Upon account deletion, your personal information (email, login credentials) will be removed within 30 days. AI-generated content (campaigns, encounters, characters, life paths) will be de-identified and retained in a non-public, non-accessible state for 90 days following deletion to comply with legal obligations, resolve disputes, or assist law enforcement. After 90 days, all retained data will be permanently purged. This retained data cannot be viewed by users and is accessible only in response to valid legal process during the retention period.

17.Modifications to Terms

We reserve the right to update these Terms at any time. We will update the "Last Updated" date at the top of this page. For material changes, we will make reasonable efforts to notify you via email or a prominent notice within the Service.

Continued use of EncounterCaster after a Terms update constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, stop using the Service and close your account.

Entire Agreement

These Terms constitute the entire agreement between you and EncounterCaster (Ryan Williams, sole proprietor, Oregon, USA) regarding the Service and supersede all prior agreements, understandings, representations, and communications — whether written or oral — relating to the subject matter herein.

No Waiver

Our failure to enforce any provision of these Terms shall not be considered a waiver of our right to enforce such provision in the future.

18.Governing Law & Disputes

Governing Law

These Terms and any disputes arising out of them shall be governed by the laws of the State of Oregon, United States, without regard to conflict of law provisions.

Informal Resolution First

Before initiating formal proceedings, contact us at support@encountercaster.com with a written description of the dispute. We will attempt informal resolution within 30 days.

Binding Arbitration

If informal resolution fails, disputes shall be resolved by binding arbitration under the rules of the American Arbitration Association (AAA), rather than in court — except either party may seek injunctive relief in court to prevent irreparable harm, or bring eligible claims in small claims court.

Class Action Waiver: You waive any right to bring or participate in class, consolidated, or representative action claims.

Arbitration Opt-Out

You may opt out of binding arbitration by sending written notice to support@encountercaster.com (Subject: Arbitration Opt-Out) within 30 days of creating your account. Your opt-out notice must include your name, email address, and a clear statement that you wish to opt out of the arbitration agreement. Opting out does not affect any other provision of these Terms.

Jurisdiction

To the extent any matter must be resolved in court, you consent to exclusive jurisdiction of state and federal courts located in Oregon, United States.

EncounterCaster uses artificial intelligence to generate encounters, life paths, character backgrounds, campaigns, hex maps, and related tabletop RPG content. In accordance with EU AI Act Article 50 (effective August 2, 2026), we make the following disclosures:

What Is AI-Generated

How We Label AI Content

AI-generated content on EncounterCaster is labeled with a visible "🤖 Generated with AI" badge on screen, in print, and in PDF exports. Machine-readable provenance metadata (c2pa:provenance) is embedded in HTML pages and PDF documents.

Creative Work Exemption

Our content qualifies as creative, fictional, and satirical work under EU AI Act Article 50's exemption. Labels are present but designed to be unobtrusive, consistent with the exemption's requirement that disclosure "does not hamper the display or enjoyment of the work."

AI Models Used

EncounterCaster routes content generation across multiple AI providers including Anthropic Claude, OpenAI GPT models, xAI Grok, Fal.ai Flux, and Replicate Flux. The specific model used for any given generation is logged in our system. For questions about AI model usage, contact support@encountercaster.com.
